Surplus Funds HQ

Terms of Service

Last updated: October 12, 2026

These terms cover your use of surplusfundshq.com (the “Site”) and the paid Pro subscription (together, the “Service”), run by Surplus Funds HQ (“we”). By using the Service you agree to them.

1. What the Service is

Surplus Funds HQ collects surplus-funds (overage, excess proceeds) lists that county clerks, treasurers, tax collectors and courts publish as public records, puts them into one format and updates them regularly. We sell access to this data and to tools built on it. We are not a government agency, a law firm, a debt collector or an asset recovery agent, and we do not file claims for anyone.

2. No legal or financial advice; accuracy

Rules summaries, guides and records are general information, not legal or financial advice. Public lists can be incomplete, out of date or wrong, and an amount on a list may already be claimed, paid, subject to other liens or sent to the state. We copy what the official source shows and link to it, but we don't guarantee that any record is accurate, current or that any money is available. Always confirm with the office that holds the funds.

3. Your responsibilities

You are responsible for how you use the data. You agree to follow all laws that apply to you, including state rules on surplus-fund recovery (fee caps, waiting periods, registration and assignment rules), telemarketing and consumer-protection laws (such as the TCPA, state “do not call” rules and unfair-practices laws) and privacy laws. You won't use the Service to harass, mislead or pressure former owners or their families, to misrepresent yourself as a government office, or to charge fees the law doesn't allow. Former owners can claim their own surplus for free, and you must not tell them otherwise.

4. Pro subscription and billing

Pro is a monthly subscription billed in advance until you cancel. Prices are shown before you pay and may change for future billing periods with at least 14 days' notice by email. Payments are processed by our payment provider, which may act as the merchant of record and reseller of the subscription and handle sales tax, VAT and billing questions. You can cancel at any time; your access continues until the end of the period you've paid for. Refunds are covered by our Refund policy.

5. Acceptable use of the data

Your Pro access is for you (or your own business) and isn't transferable. You may use exports for your own work but may not resell, republish or redistribute the Service's data in bulk, share your access, or scrape the Site in a way that harms it. We may suspend or end access that breaks these terms, without refund for the current period.

6. Availability and changes

We work to keep the Service running and the data fresh, but county sources change or go offline, and the Service may be interrupted. We may change, add or remove features, states or counties at any time.

7. Limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind. To the fullest extent allowed by law, we aren't liable for indirect, incidental or consequential losses, lost profits or lost deals, or for decisions you make based on the data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

8. Privacy, removal and contact

See our Privacy policy. To correct or remove a record from the Site, see remove a record. We may update these terms; the date above shows the latest version, and continued use means you accept it. Questions: hello@surplusfundshq.com.
